What am I entitled to claim?

When the government takes your property, the Constitution of the United States and the New York State Constitution require that you must be paid “just compensation” (i.e. fair market value) for the property taken at its highest and best use.

This is not the value of the property “as is”. Often, property is not being used to its full potential. You can show that the property has development or market value greater than the way it is actually being used.
